FABRIKUS WORLD is a simplified joint stock company with capital of €4,391,446, domiciled at Chemin du Tricot et des Tôts 34450 VIAS, registered in the Béziers Trade and Companies Register under No. 890 609 068 (hereinafter the " Park ").
The Company operates the FABRIKUS WORLD theme park, located Chemin du Tricot et des Tôts 34450 VIAS - France.
These general conditions of sale (hereinafter the " GCS ") apply to all services (hereinafter the "Services") offered by the Company to a non-professional customer (hereinafter the " Customer ").

All orders placed on the www.fabrikusworld.com website (hereinafter referred to as the "Website"), by telephone, by e-mail and at the park ticket desks imply express acceptance of the GTS by the Customer.
The customer declares that he/she has read these GTC before purchasing tickets online and acknowledges that he/she has been informed that validation of the order implies unreserved acceptance of these GTC.
The information contained on the website or in any brochures, as well as the GTC, constitutes pre-contractual information. It is expressly stated that the information may be modified at any time during the season. Information relating to shows, attractions, stores, entertainment, restaurants and other ancillary services may only be known on the day of the visit. Each new version will be accessible on the www.fabrikusworld.com website and can therefore be consulted by the customer before each order.
No deviation from these GCS will be accepted without the Park's prior written agreement.
ARTICLE 1 - Description of Services
The Park makes every effort to describe the Services as accurately and precisely as possible, on the spaces dedicated specifically to the Service on the Website and in commercial brochures.
The Park is at the Customer's disposal for any information request by telephone or e-mail.
The Park cannot be held responsible for any non-essential discrepancies between the photographs on the Website or commercial documents and the Services.
All terms and conditions of validity of prices and offers are indicated on the www.fabrikusworld.com website.
The services sold are as follows:
- Visit the Park for one day, one week or one season (depending on the ticket chosen), during the Park's working days and hours, giving unlimited access to all the Park's attractions (rides) for the duration of the visit, excluding catering, stores, stands and any related paid services.
- In addition to the possibility of visiting the Park, the Customer may purchase additional related services on site. The list of Services currently offered by the Park is available on the Website. This list is not exhaustive and is subject to change. The Park is free to delete, modify or offer new Services.
ARTICLE 2 - Prices
Prices are given in euros, inclusive of all taxes, and are based on the taxes in force on the date the order is placed. They may be revised after the publication of commercial brochures and at any time during the Park's opening season.
After order confirmation, the sales price is guaranteed.
The elements included in the price of the Services are described on the areas of the Site specifically dedicated to the Service and in the commercial brochures.
For the purchase of :
- Liberty ticket or Dated ticket: the price includes access to the Park for one day for one person;
- Week pass: the price includes access to the Park for one week (7 days) for one person;
- Annual pass: the price includes access to the Park for one year (365 days) for one person;
The park visit service does not include meals, games in the stands, purchases in the stores or any other expenses of a personal nature.

- Depending on the visitor's age :
The "- 12 years" rate applies to children aged 4 to 11 inclusive.
Children under 4 and adults over 70 are admitted free of charge. The visitor's age is taken into account on the first day of the Park visit.
Proof of date of birth may be requested before or during the Park visit.
In the absence of the required documents, the "+ 12 years" rate is automatically applied.
Special rates for senior citizens (60 to 69 years old inclusive), students and disabled people are only available for tickets purchased directly from the Park's ticket offices on presentation of proof of age.
- Depending on the frequency of the ticket :
Certain tickets, with a periodicity specified at the time of purchase (Pass, Dated Ticket), benefit from specific pricing
- Depending on the number of tickets in the same order ( Tribe Pack from 4 to 19 people )
For more than 20 people in a single order, the request is subject to a quote from the sales department and to preferential pricing under the conditions set out in the Group's general sales conditions.
The sales department is available by email or by telephone at the contact details given at the top of this document. Requests for quotations must be made at least 7 days before the desired visit date.
ARTICLE 3 - Placing an order
The Park draws the Customer's attention to the fact that the purchase of undated tickets does not guarantee access to the Park on busy days.
The Services offered can be ordered on the Website.
When placing an order on the Website, the Customer is invited to identify him/herself using a form to create a personal Customer account.
The customer can check the details of his order and its total price at any time.
To finalize the order, the Customer must read and accept the General Terms and Conditions of Sale by ticking the appropriate boxes, and proceed to payment in accordance with the terms and conditions set out in article 4 below.
For all Anniversary Offer orders, the customer must specify the date requested for the related service.
The purchase of a Service will only be firm and definitive once the full price has been received by the Park.
For all purchases, the Customer will receive an order confirmation, once full payment has been made, summarizing in particular the purchases made, the price applied, the proof of full payment, the essential characteristics of the Service(s) ordered, as well as the dematerialized access ticket(s) where applicable.
ARTICLE 4 - Terms of payment
The Park accepts the following methods of payment:
- For all purchases on the Website: credit card.
Bank charges incurred by the transaction for any reason whatsoever remain the responsibility of the Customer.
In the event of non-payment of the order, the Park reserves the right to cancel the order and, where applicable, any Tickets issued in the Customer's name and sent by email.
Payments made on the site are secured by the use of an encryption process guaranteeing the confidentiality and security of banking data (3D Secure).
Services purchased at the entrance to or within the Park are payable in a single instalment by credit card, in cash or by means of vacation vouchers under the specific conditions laid down.
ARTICLE 5 - Modification, Exchange, Cancellation and Refund
Tickets cannot be changed, exchanged or refunded.
Failure by the Customer or a visitor to show up on the day of the Event, the date of the ticket or the end of a ticket's validity will result in the Park collecting the full price. Under no circumstances may the price be refunded, whatever the cause of the Customer's absence. Any interrupted, abbreviated or cancelled Service, or any Service not used by the Customer, for whatever reason, will never be reimbursed when subscribed.
For dated Tickets only, in the event of unforeseen closure of the Park on the date of the visit ordered, requests for postponement or refund must be made by the customer as soon as possible in writing to the Park. If the request is duly validated and accepted by the Park, the Park will issue a new ticket for the new visit date indicated by the customer on the days when the Park is open, or will issue a refund.
ARTICLE 6 - Withdrawal period
In accordance with article L 221-28, 12° of the French Consumer Code, the Customer does not have a legal right of withdrawal for the purchase of tickets for leisure activities for a specific date or period.
ARTICLE 7 - Personal data
The Customer's personal data, and where applicable that of any third party mentioned by the Customer, are processed automatically by the Park, in accordance with the conditions set out in the site's legal notice ( https://www.fabrikusworld.com/mentions-legales/ ).
ARTICLE 8 - Responsibilities
In particular, the Park decides on opening days and times, and on the related services it offers.
The Park may decide to close all or part of the Park to the public and suspend all or part of the Services offered, for as long as it deems necessary, in particular due to issues or operations relating to the safety or health of visitors, maintenance, repair, rehabilitation, restructuring of all or part of the Park's equipment, bad weather, public order, privatization of the Park or part of the Park, etc., without being held responsible and without the Customer being able to claim compensation of any kind whatsoever.
The Park declines all responsibility for damage of any kind, and in particular for theft, damage and/or loss to belongings, objects or materials brought by visitors. All visitors are responsible for any direct or indirect damage they may cause while in the Park.
The Customer undertakes, on his/her own behalf and on behalf of any visitors accompanying him/her, to comply with the Park's internal regulations and all safety rules posted in the Park. The Park shall not be held liable for any damage resulting from failure by the Customer or any visitor to the Park to comply with safety regulations. The Park's authorized services have the right to expel any offender without recourse. Visitors who are expelled from the Park may not be reimbursed under any circumstances.
The Park may not be held liable in the event of non-compliance with its obligations due to a fortuitous event, force majeure or the actions of any person outside the Park, such as, but not limited to: strike, fire, water damage, impossibility of access, climatic conditions, epidemic, decisions emanating from authorities, etc., i.e. any situation beyond the control of the Park and any service provider involved in the performance of the Service, the consequences of which could not have been avoided even if all reasonable measures had been taken, and which prevent the performance of all or part of the obligations provided for in the contract.

ARTICLE 10 - Complaints and dispute resolution
Any complaints arising during a visit to the Park must be made as soon as possible on site at the Park reception desk.
A solution will be provided immediately by the Park's teams.
Complaints that cannot be made on site, that cannot be resolved satisfactorily on site or that concern the purchase of a ticket on the site must be sent to the Park within fifteen ( 15 ) days of the end of the Service, by registered post with acknowledgement of receipt or by e-mail as mentioned in the heading of this document, specifying the reasons for dissatisfaction, the date of the visit and all proof of visit.
Both the interpretation and implementation of the GTCS are governed by French law.
After having sent the complaint to the Park in accordance with the terms of article 8 above, and without a satisfactory response from the Park within sixty (60) days of receipt of the complaint, the Customer may use the online dispute resolution platform ( RLL ) accessible via the link ec.europa.eu/consumers/odr.
